ROMPe, in its role as creator and distributor, does not assume responsibility for the adequacy of the available services to the preferences of the Patrons. The Patron is responsible for evaluating the suitability of the available services to achieve a satisfactory level of use. 


2. Access to Services. 

Access to the contracting of the available services is exclusive to Patrons.

 

The Patron identification code (hereinafter "Code"), with which you access the available offer, contract and use of the services marketed, is personal and non-transferable

All persons determined by the Patron at the time of hiring may benefit from the use of the aforementioned services. 

The Patron receives 100% of the benefits linked to its Code and derived from the use of the services contracted on the www.wayliv.com website. 

To be a Patron, you must be at least 18 years old or the age of majority in your country. Persons under 18 years of age or under the applicable age of majority in your country may use the contracted services under the supervision of their parents or legal guardians through their Patron Code, to whom these Terms of Use and Contract apply.

At the time the Patron unsubscribes, the decision is irreversible and entails the immediate loss of access to contract new services on the www.wayliv.com website, as well as all the benefits linked to their previous status from the effective date of this.

Currently, the www.wayliv.com website aims to provide intermediation between the Patron and providers of accommodation services, tax advisory services and obtaining VISAS for non-EU nationals. ROMPe may modify these services at any time. 

Through the website, ROMPe offers Users and Patrons the possibility of accessing: Information about ROMPe, your contact details, your products and services, your rates, your commercial offers, and your location - A contact section to make inquiries by providing your personal data - (hereinafter the "Services"). 

These Terms of Use and Contract regulate access to and use of the www.wayliv.com website, as well as the relationship between Users and Patrons with Wayliv

CONDITIONS OF ACCESS AND USE 

  • Access: Access to the website is free. However, access to some service information requires prior registration as a User and/or Patron and the contracting of the services requires the payment of a membership.


  • Registration: Users and Patrons undertake to provide truthful, verifiable information and keep it up to date.


  • Use: Users and Patrons undertake to use the website in a lawful manner and not to carry out activities that may damage, limit or impede its infrastructure and proper functioning.

PRIVACY AND DATA PROCESSING

As a User and/or Patron you undertake to:

Likewise, the User and/or Patron acknowledges and accepts the obligation to indemnify ROMPe against any damages arising from the use by it of "robots", "spiders", "crawlers" or similar tools used to collect or extract data and/or any other action on its part that entails an unreasonable burden on the operation of the website.

  • Wayliv: Technological platform through which Visitors and Users are informed, and Patrons are informed and hire exclusive services.


  • Platform: A set of websites and applications through which ROMPe serves under the Wayliv trademark.


  • Visitor: Any person, natural and/or legal, who visits the website and does not register as a User. It only accesses public information.


  • User: Any person, natural and/or legal, who visits and registers correctly on the website, who accepts and complies with the Terms of Use and Contract, as well as with the Privacy Policy.

    This registry gives automatic access to all available public and private information, without the ability to book services.

     

  • Patron: Any person, natural and/or legal, correctly registered on the website, who accepts and complies with the Terms of Use and Contract, as well as with the Privacy Policy and is up to date with the payment of a Wayliv membership.

    Loss of Patron status occurs when one of the following events.

    (i)               Non-payment of the membership on the date indicated in the contract.

    (iii)            Forced leave. At the discretion of ROMPe and, in any case, for breach of the Terms of Use and Contract of the website.

  • Privacy Policy: Wayliv's commitment to the processing of the personal data of Users and Patrons. A rigorous and respectful commitment to the applicable legal framework in force in all the countries in which Wayliv operates. Membership rates are public as you can see at www.wayliv.com. There are additional onboarding, fidelity, and upgrade benefits that you only know about when you register as a User. So you see how important you are to us. How much, specifically.

Your membership prices don't change for as long as you keep it active. This ensures your continued access to all the services available on the www.wayliv.com website with no changes in cost. 

You do not suffer from a fare increase while maintaining your Patron status. You also do not suffer a rate increase when you decide to change your membership modality.

Wayliv MEMBERSHIP CONDITIONS

Be up to date with the payment of the fee corresponding to the membership model you want.

As a Patron, you agree to comply with the following conditions:

When a Patron loses their status, ceases to belong to Wayliville, the Wayliv Patron community and automatically becomes a User.

In the event of loss of Patron status, ROMPe has the right to reject any application for registration or to cancel a previously accepted registration. In addition, it has no obligation to communicate or detail the arguments of its decision and this event does not generate any right to compensation or compensation.

    (ii)              Confirms your reservation.

    (iii)            You receive all the necessary information and documentation.

    (iv)            You receive your invoice. If you asked for it. If not, no.

 

  • Cashback. Easy too. You don't have to do anything. Wayliv automatically credits you in the same means of payment that you have used to book the services, the cashback that corresponds to your membership when you use the booked services.

    (i)               First credit. 48 hours after the date you start using the booked services.

    (v)              You check your means of payment account. You see your cashback.

    (vi)            You are done for the day. You got it.

ACCEPTED FORMS OF PAYMENT

The contracting of the services marketed on the www.wayliv.com website can only be carried out with the means accepted by the platform that ROMPe decides as a Payment Services Partner.

ROMPe requires you to be the owner of the means of payment you use to activate your membership and book on the www.wayliv.com website. It is your sole responsibility to use the means of payment in accordance with the instructions of your financial provider and to be aware of the conditions agreed upon. 

ROMPe is free to decide on changes in its Payment Service Partner.

ROMPe undertakes to inform the Patrons through the email registered in the Wayliv community account, of the changes with sufficient notice, clarity and transparency.


  • Wayliv membership fees.

    The Patron receives the payment charge for the membership (TRIP - PROJECT - LIFE - CORP) on the same day of the purchase in the means of payment with which the hiring is completed.

    Renewal of PROJECT - LIFE membership requires explicit consent granted by the Patron. Otherwise, the Patron acknowledges and accepts the automatic renewal of the membership in TRIP mode and the adjustment of the commercial conditions and linked benefits.

    In subsequent periods, the charge is made on the same day of the following periods until the end of the membership or modification of the same.

    Renewal of the CORP membership requires explicit consent granted by the Patron. Otherwise, the Patron acknowledges and accepts that its action amounts to a request to unsubscribe.

 

  • Service booking fees.

    The Patron receives the payment charge for the booked services on the same day of the purchase in the same means of payment with which the booking is made. In services lasting more than 1 month, the charge is made on the same day of the following months until the end of the contract.


By accepting these conditions, you authorise ROMPe to store your means of payment and to automatically charge them the amounts linked to your membership and booked services on the corresponding date, during all applicable periods until your cancellation as a Patron

The Payment Services Partner is the sole recipient of the data related to your means and payment data, ROMPe does not have access to this information, so, in the event of any eventuality, the Payment Services Partner is the sole controller of this information and to whom you must raise the claim in the event of incidents with your payments. 

RIGHT OF WITHDRAWAL AND REFUND

  • Wayliv Memberships.

    Unsubscribing at any time is your right.

    Acknowledging and accepting these Terms of Use and Contract means that unsubscribing automatically and unequivocally entails the following:

    (i)               You lose your Patron status and the linked benefits.

    (ii)              You waive the refund of the fee paid, not taken.

 

  • Services.

    The policy and practices of withdrawal and reimbursement to Patrons for cancellations of reservations of the services marketed on the www.wayliv.com website, observe and comply with the regulatory framework in force in each country in which Wayliv operates.

    In general, Patrons can exercise their right to withdraw at any time.

    The date of exercise of the withdrawal determines the refund applicable to the charges made for the booking of the services made on the website www.wayliv.com


    Refunds in Wayliv work like this:

    Date of withdrawal - Date of start of service -

    (i)               Greater than 15 days. Refund, 90% of the booking fee.

    (ii)              Greater than 7 days. Refund, 50% of the booking fee.

    (iii)            Less than 7 days. Refund, 0% of the booking fee.

    The reimbursement of the amounts is made by payment in the same means of payment with which the Patron books the services, in cases where appropriate.

    Please bear in mind that, in accordance with the Law on Consumers and Users, accommodation services for purposes other than housing, when a specific date or period is foreseen for their use, does not grant you the right of withdrawal generally provided for the contracting of other services.

    Therefore, you can only request the cancellation of the booking, and the refund of the amount paid, under the terms provided for in the specific conditions of the hospitality provider.  

PATRONS OBLIGATIONS

The Patron acknowledges and accepts its obligation to properly use the www.wayliv.com website and all its content and services under the Terms of Use and Contract and Privacy Policy.


ROMPe determines that it is appropriate to comply with the following provisions:

  • Read and verify that you meet the requirements for acceptance of these Terms of Use and Contract and the Privacy Policy.


  • Read and verify that you meet the requirements for contracting the services marketed on the www.wayliv.com website, under the specific conditions provided by the Partners.


  • Not to make bookings for services without the actual intention of use.


  • To use only means of payment of your own.


  • To comply with the obligations contracted with the Partners, under the terms provided for in these Terms of Use and Contract.


  • To not provide third parties with the theft of information or content, manually or automatically.


  • Not to use the information on the www.wayliv.com website for your own or third parties' commercial activities.


  • Not to carry out any type of action that involves the alteration, deletion or omission of the security measures of logical access and/or access to the computer resources and data hosted on the servers of the website www.wayliv.com


  • To pay for the services requested to obtain the expected outcome. 

Wayliv OBLIGATIONS

  • Safeguard the data of Users and Patrons under the Privacy Policy.

     

  • To offer clear, transparent, truthful and up-to-date information on the services marketed on the www.wayliv.com website.

    Specifically, the following general conditions of Wayliv memberships.

    (i)            Cashback on service prices excluding applicable taxes.

    (ii)              Voluntary resignation at any time. (Unsubscribe). The unsubscribe option is available in all communications. No fee refund.

    (iii)            Automatic renewal at the end of the period.

    PROJECT - LIFE - CORP, 4 prior communications for renewal. 30, 15, 7 and 1 days.

    TRIP, 3 prior communications for renewal. 15, 7 and 1 days.

    (iv)           Upgrade – Downgrade at any time. The Upgrade – Downgrade option is available on all communications. No fee compensation.

    (v)         In Wayliv memberships you waive the refund of the unused fare from the date on which the cancellation event occurs.

    (vi)            Communication to Patrons of account statement. Monthly by default. Always at the end of the period of use of the contracted services.

    (vii)              Commercial communication to Users and Patrons of changes to the website and/or services marketed. At the time it occurs.

    (viii)            Commercial communication of campaigns to selected Users and Patrons. At the time of launch, validity and termination with the periodicity defined by ROMPe.


  • Facilitate the booking process and/or connections with Partners under these Terms of Use and Contract.


  • To mediate with the Partners for all matters related to the process of information, booking, use, incidents, and cancellation, when applicable

RESPONSIBILITIES

ROMPe, through the www.wayliv.com website, carries out an intermediation service, so in no case does it assume any type of responsibility arising from the obligations of the Partners, nor from the rights that, as consumers and users, the Patrons have concerning the booking and use of the services provided by the Partners

However, from ROMPe we thank you and suggest that you share all the information about any type of incident related to your experience. Thus, Wayliv serves you better. Your way. Like a pro.

Consumers can submit their complaints through the aforementioned online dispute resolution platform. 

APPLICABLE LAW AND COMPETITION

Both these Terms of Use and Contract, as well as the provision of the services you contract on the www.wayliv.com website, are governed and interpreted in accordance with Spanish law. 

The Courts of Madrid, Spain, are competent to resolve any conflict that may arise from these Terms of Use and Contract and/or the provision of services, between the Patron and ROMPe, in accordance with applicable Spanish legislation. 

ARBITRATION

Any difference, lawsuit, dispute or controversy that may occur between the Parties concerning these Terms of Use and Contract, may be submitted to an arbitration mediation instance of the Madrid Chamber of Commerce

For the enforcement of the award and any other case outside the arbitral jurisdiction, the Parties submit to the ordinary jurisdiction of the Courts of Madrid, Spain. The corresponding arbitration award shall be final and unappealable for the Parties.
